Jack Smith has subpoenaed Former Vice President Mike Pence. During the attack of the U.S. Capitol on Jan. 6, Trump supporters shouted “Hang Mike Pence!” Last year, Pence said “President Trump is wrong” and that “I had no right to overturn the election.” For these and other reasons Pence may be inclined to cooperate. Because this is a Department of Justice subpoena, it is my opinion that he will have to testify before a grand jury regardless of whether he cooperates or not.

These are states that Trump and his allies targeted in order to rig the election and stay in power following the 2020 election. The subpoenas requested any and all communications with Trump and his campaign, and included a list of aides and allies. Post-2020 election communications between Republicans and Trump were included.
