Merrick Garland should have arrested former President Donald J. Trump because of a sacrosanct U.S. principle that all people are equal before the law. This has not happened and numerous safeguards have failed primarily because U.S. Attorney General Merrick B. Garland is taking too long to indict Trump.
Jack Smith may now move to indict Trump.
So, the question now is, “how do we stop Trump and save democracy after the law has not worked?”

United States Attorney General Merrick Garland should have already subpoenaed, indicted and arrested former U.S. President Donald J. Trump, and his decision to appoint a special counsel may have been a mistake.
It is becoming evident that the failure of Merrick Garland and the Department of Justice requires a systemic overhaul of the entire Justice System before Trump does it.

Democracy appears to have survived one more day! Democrats did better than predicted, but the battle could continue as votes are counted slowly in key states. The Senate will likely remain in Democratic control. And even if Republicans get a majority in the House of Representatives, they will be stymied by the need for Democratic cooperation to pass legislation. At the same time, former President Donald Trump will likely now be indicted by the Department of Justice.

To stop Trump and save democracy we need the Department of Justice to arrest and convict Trump of 18 U.S. Code § 1510 – Obstruction of criminal investigations.
After complaining endlessly about Hilary Clinton’s emails, Trump left top secret documents scattered on the floor in his private residence. Because U.S. Attorney General Merrick B. Garland has previously stated that no one is above the law, it is almost certain that Trump will be indicted and arrested. And as I have said before, Trump will go to jail and prison.
Trump may have had documents revealing the location of nuclear missile launch sites. His plan: To threaten to reveal these locations to Russia or Iran if he were to be arrested. (More reasons to indict and arrest Trump.)
Why Trump is going to be indicted
The reasons why United States Attorney General Merrick Garland will likely bring Trump to trial soon. The United States Justice Department will indict and convict Trump.
The January 6th Committee presented a 7th hearing.
Former Oath Keeper, Tatenhove says that we should “call things for what they are,” and that “the Oath Keepers was s a paramilitary force that President Trump was engaging. This was an armed revolution that could have been a spark that started a civil war.”
The gallows set up for Mike Pence was “only a hint,” he says, “of what could have happened. We were lucky. It could have gotten much more violent.” With concern for his children’s future he said “I fear for the world, what will happen if we do not hold these leaders accountable for their actions,” Said Van Tatenhove.
02/08/22 UPDATE: The National Archives retrieved 15 boxes of White House records from Trump’s Mar-a-Lago home which included letters from Barack Obama and Kim Jong Un. Trump has violated the Presidential Records act in this and other ways. While in office he routinely ripped up correspondences and records that are required by law to be retained. Hundreds of official documents received by the Archives are scotch-taped back together or still in pieces.
When the Supreme Court denied his claim of executive privilege, in order to conceal exactly what he was doing before, during, and after the January 6 attack on the Capitol, he shredded government documents.
Destroying federal records during a presidential transition is a federal crime.
02/05/22 UPDATE: Former Vice President Pence said that Trump “was wrong” to say he could overturn the most secure election in history and the vote of the people. The percent probability that Trump will be indicted, arrested and sent to jail suddenly went up as a result of that public clarification that one person cannot choose who will be president.
This statement may be a prelude to testimony Pence will give to the January 6th committee. The ramifications of his testimony combined with an indictment and arrest of Trump would be huge. Our democracy may be saved yet!
01/31/22 UPDATE: Over the weekend at a Trump rally in Texas former President Donald J. Trump openly confessed to seditious conspiracy (18 U.S. Code § 2384 – Seditious conspiracy) and to aiding and comforting a violent insurrection (18 U.S. Code § 2383 – Rebellion or insurrection). Trump offered pardons to the January 6th insurrectionists should he be reelected president. He was not under duress and the confession was in plain sight in public view.
Seditious conspiracy carries 20 years and rebellion or insurrection carries 10, and those convicted of rebellion or insurrection can never hold public office again.
The grand jury in Georgia will be given this information and U.S. Attorney General Merrick B. Garland will have to act on it. By clear definition, this is domestic terrorism by a former president. Trump is daring the Justice Department to indict him and is threatening that if they do indict him that he is sending his angry mob after them.
Trump admitted to sending Vice President Pence to overturn the election and when that failed to send a mob to overturn the election. In both cases he was organizing an effort to overturn the election.
I expect Trump to be indicted or taken into custody and am surprised it has not happened yet. Trump will be indicted, arrested and sent to prison or we are basically all doomed. It seems almost inconceivable that Merrick Garland has not yet indicted and arrested Trump.
Fulton County District Attorney Fani Willis may be the one to take down Trump. She wrote a letter asking the FBI to protect her after Trump made his threats at his rally over the weekend.

01/28/22 UPDATE: The January 6th Select Committee subpoenaed 14 “Alternate Electors.” They are looking at how the Whitehouse was coordinating a parade of fake Electoral College certificates in seven states, Arizona, Georgia, Nevada, New Mexico, Wisconsin and Pennsylvania.
Federal investigators are already looking at the possibility that federal law was violated by the existence of matching paperwork showing fake electors lying for Trump. If only one of the fake electors admits to the plot, the entire Trump conspiracy will be proven and seditious conspiracy election fraud charges will be levied on all those involved, including Trump.
Trump will soon be subpoenaed, indicted, arrested and sent to prison.

Trump Whitehouse spokesman, Judd Deer, was also subpoenaed today to seek his knowledge of Trump’s behavior on or around January 6th.
01/06/22 UPDATE: U.S. Attorney General Merrick B. Garland’s remarks yesterday indicate that the DOJ will hold Former President Trump and others at the top accountable for their actions tied to the Jan. 6th insurrection.
Garland said the DOJ is committed to the rule of law and to following the facts wherever they lead.
Garland vowed that the DOJ would pursue wrongdoing “at any level.” Specifically, that the DOJ would defend democratic institutions from attack and threats of violence.
So far, federal charges have been levied against over 700 of Trump’s supporters who ransacked the Capitol in a bid to stop the certification of U.S. election.
